Right of Publicity In New York Can't Stop Marilyn Monroe Image Sales
A New York federal judge has ruled that Marilyn Monroe's right of publicity died when she did in 1962, paving the way for family members of the late photographer Sam Shaw to continue selling and licensing images of the icon, including the photo of her standing above a subway gate.

Quite right.
How can anyone have privacy when they're dead?
That said, there could be a case to secure a right to privacy for 100 years since birth (or until death, whichever later), to be rescinded upon earlier death only if the death is incontrovertibly above suspicion. This to dissuade assassins.
The other issue to bear in mind is that a dead person's loss of their right to privacy doesn't trump the right to privacy of those living, e.g. if Monroe's photos or memoirs contain private and unpublished details of anyone else still living, they must still require approval.
